Robotic surgeon faces medical malpractice litigation in Colorado

Medical professionals have an obligation to exercise proper safety precautions when providing medical care. If a mistake does happen to occur during a medical procedure, medical professionals are required to include details of the mistake in their reports. However, one Colorado surgeon is being accused of failing to do this for 11 supposedly mishandled surgeries, which has resulted in at least one medical malpractice lawsuit.

The types of malpractice acts the surgeon is being accused of range from forgetting surgical equipment and even sponges inside of the bodies of patients to improper usage of robotic surgical equipment during surgical procedures on kidneys of patients. The doctor is now facing 14 charges of unprofessional conduct filed by the state’s medical board. The safety of the particular robotic surgical equipment that the doctor used is currently being investigated by authorities.

The doctor used what is known as the da Vinci Robot system, which has been available to medical professionals since 2000. The surgeon used the system during multiple kidney transplant surgeries. A lawsuit that is currently pending alleges that the doctor misrepresented the safety of the robotic surgical system, while also not offering an option for standard surgery without use of robotics.

Those in Colorado who may have been injured due to mistakes made by a surgeon, whether using robotics or not, may be able to obtain some monetary reimbursement for damages. If a surgeon or any other medical professional does not offer an acceptable settlement offer, it may be necessary to litigate in court by filing a medical malpractice lawsuit. With knowledge of applicable law as well as court procedure and rules, one may be able to prevail in court.
